1 Acceptance of Terms

By accessing or using ModelPassport ("the Service"), including the web interface at modelpassport.ai and the REST API, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and ModelPassport ("we", "us", "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2 Use of Service

ModelPassport provides an AI bias audit and certification service. In using the Service you agree to:

  • Provide accurate information about the model and organization you are auditing.
  • Only upload datasets and models that you own or have explicit authorization to audit.
  • Not use the Service for any unlawful purpose or in violation of applicable regulations.
  • Not attempt to reverse-engineer, scrape, or abuse the API beyond documented rate limits.
  • Not use audit results in a misleading way — certificates must be presented with their full context, including any warnings or conditional status.

3 No Warranty on Audit Results

⚠️ ModelPassport audit results are provided "as is". They represent a statistical assessment based on the data and model you provide and should not be interpreted as a legal certification of regulatory compliance.

While we design our audit methodology to align with regulatory frameworks including the EU AI Act and EEOC guidance, a ModelPassport certificate does not constitute legal advice, regulatory approval, or a guarantee against discrimination claims.

The quality of audit results depends directly on the quality and representativeness of the data you provide. We make no warranty that our audit will detect all forms of bias or that a passing score guarantees absence of bias.

You should consult qualified legal counsel regarding applicable fairness regulations in your jurisdiction before deploying AI systems in high-stakes contexts.

4 Limitation of Liability

To the maximum extent permitted by applicable law, ModelPassport and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the total amount paid by you to ModelPassport in the twelve months preceding the claim. For free tier users, this limit is ₹0.

5 Acceptable Use

The following uses of the Service are strictly prohibited:

  • Auditing models intended for illegal purposes, including surveillance systems targeting protected characteristics.
  • Uploading datasets containing personal data without appropriate authorization or anonymization.
  • Attempting to game the audit — submitting pre-processed data specifically to achieve a higher score while the production system uses different data.
  • Using audit certificates in marketing materials that misrepresent the audit scope, limitations, or findings.
  • Automated scraping, DDoS attacks, or any activity that degrades service availability for other users.
  • Using the Service to audit systems designed to circumvent legal protections for individuals.

Violation of this acceptable use policy may result in immediate termination of access and, where applicable, legal action.

6 Intellectual Property

You retain full ownership of all data, models, and materials you upload to ModelPassport. We claim no rights over your intellectual property.

ModelPassport's software, methodology, brand, and documentation are protected by copyright and other intellectual property laws. You may not copy, reproduce, or create derivative works from the Service without our written permission.

Certificate data (scores, metadata, hash) is public domain once published in the certificate registry — this is necessary to enable the public verification feature.

7 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8 Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email (if you have provided one) or by prominent notice on the Service. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
